Agreement to Terms & User Eligibility
By accessing, browsing, registering an account, making advance payments, or boarding any transport operated or managed by DwipachalTour ("Company", "we", "us", or "our"), you confirm that you have read, understood, and agreed to be legally bound by these Terms of Service under the Contract Act 1872 and the Information & Communication Technology Act 2006 of Bangladesh:
You must be at least 18 years of age to book travel packages independently. Minors must be accompanied by an adult parent or authorized legal guardian.
You warrant that all passenger names, emergency contacts, and identification documents provided during reservation are truthful and match official government identity cards.
Booking Process, Seat Locks & Smart Passes
Our platform operates a real-time smart booking infrastructure to ensure seamless seat allocations without double-booking conflicts:
- Temporary Seat Lock Window: When you choose bus seats during checkout, they are temporarily locked for your session. If payment confirmation is not completed within the designated window, the seats are automatically returned to public availability.
- Official Smart Booking Code: Every successful booking receives a unique code (e.g., SJ-1014-042) and digital pass with QR verification. You must show this digital pass on your smartphone or printout during bus boarding.
- Advance Booking Terms & Balance Settlement: For packages with advance payment options, the remaining balance must be settled prior to boarding or as instructed by DwipachalTour coordinators. Unpaid balances forfeit the booking without refund of advance payments.
Payment Methods & Anti-Fraud Security
All financial transactions must be conducted through our authorized payment gateways or designated merchant accounts:
bKash Merchant, Nagad, and Rocket payments must be completed via official gateway screens or verified TrxIDs.
Visa, Mastercard, and UnionPay processed via encrypted PCI-DSS compliant OwnPay / SSLCommerz gateways.
Bank wire slips for corporate charters must be confirmed by our accounting audit desk prior to departure.
Tour Inclusions, Exclusions & Price Stability
Every package clearly enumerates all entitlements. Please review specific tour pages before booking:
- Round-trip AC/Non-AC highway chair coach transport.
- Hotel / Resort rooming sharing according to booked tier.
- Scheduled meals, BBQ dinners, and indigenous dining as advertised.
- Chander Gari / boat / 4x4 off-road local transit for sightseeing.
- Dedicated tour host coordination and safety supervision.
- Personal expenses, shopping, laundry, and extra snacks/beverages.
- Optional adventure entry fees (e.g., zip-lining, water-sports).
- Medical costs, emergency medication, and hospitalizations.
- Anything not explicitly listed in the confirmed tour package.
Reporting Time, Boarding & Prohibited Conduct
Group tours operate on precise schedules to ensure road safety, ferry connections, and police escort clearances (such as the Khagrachari–Sajek army convoy):
Travelers must report to the specified pickup counter at least 30 minutes before the scheduled departure time. Transport will not wait for late passengers to maintain schedule integrity for other travelers. Late arrivals are considered no-shows under the Refund Policy.
Illegal narcotics, unauthorized weapons, contraband, fireworks, and hazardous chemicals are strictly forbidden under Bangladesh law. Any passenger engaging in harassment, disorderly conduct, or jeopardizing fellow travelers will be offloaded immediately without refund and reported to local authorities.
Tour Guide Authority & Cultural Sensitivity
During the expedition, the assigned Tour Guide / Trip Host represents DwipachalTour. Their instructions regarding safety, route adjustments, departure timings, and checkpost registrations are final and binding.
Travelers must respect the cultural heritage, religious sites, and indigenous customs in hill-tract and coastal zones (e.g. Sajek, Bandarban, Saint Martin). Littering, damaging living coral, or disturbing local residents is strictly prohibited under our eco-friendly travel ethos.
Cancellations, Rescheduling & Refunds
All cancellation requests and travel modifications are governed strictly by our official Refund & Cancellation Policy:
Force Majeure & Unforeseen Circumstances
DwipachalTour shall not be held liable for failure or delay in executing itineraries caused by circumstances beyond reasonable operational control (Force Majeure):
- Severe meteorological events, tropical cyclones, flash floods, or landslides.
- Ferry channel suspensions, maritime warning signals (Signal 3/4+), or naval lockdowns.
- Government security lockdowns, hill-tract entry restrictions, or road blockades.
In such unforeseen events, the tour coordinator reserves the right to adjust routes or reschedule the journey. If a tour is cancelled entirely by DwipachalTour prior to departure due to force majeure, travelers receive 100% full refund credit with zero cancellation deductions.
Health, Fitness & Traveler Liability
Certain tours involve hill trekking, long coach journeys, or boat transit. By booking, you affirm that you and members of your booking are physically fit for the itinerary:
Travelers suffering from chronic health conditions (cardiac, asthma, motion sickness, pregnancy) must inform the tour host in advance and carry their personal prescription medication. DwipachalTour provides primary first-aid but is not a licensed healthcare facility.
Travelers Club & Travel Credit Rewards
- Club rewards (trip cashback, review, profile and badge rewards) are paid as Travel Credit. Travel Credit can be used to pay for bookings only and cannot be withdrawn as cash.
- Cashback is calculated on the amount paid for a completed trip, excluding any Travel Credit used. If a rewarded booking is later cancelled or refunded, or a rewarded review is removed, the reward is taken back from your balance.
- Review rewards are given once per tour, only for tours you completed with us. Club tiers, rates and perks may change; changes apply to rewards earned after the change.
Governing Law & Legal Jurisdiction
These Terms of Service and all related travel agreements shall be governed, construed, and interpreted in accordance with the substantive laws of the People's Republic of Bangladesh. Any dispute arising out of or in connection with our services shall first be submitted to mutual amicable conciliation. If unresolved, the competent civil courts of Dhaka, Bangladesh shall have exclusive territorial jurisdiction.
